Application for development of the land for the erection of three log cabins for holiday let purposes. Members were minded to refuse this application at a previous meeting.

Introduction:-

 

The application was deferred at the last Committee. There is an update on the application on the Agenda. The applicant has also now provided an Artists Impression from the log cabin manufacturers and a Street Scene elevation (this shows the anticipated size of the soft landscaping after 5 years growth).

 

Consultations:-

 

No additional consultations have been made.

 

Appraisal:-

 

The Artists Impression (shown with a grey stain) is an illustration of the finished product. As this is a bespoke design it has not been possible to provide actual photographs of a similar style in situ. The Street Scene elevation illustrates the landscaping and additional planting 5 years hence. The elevation is drawn from Cadeby lane looking north.

 

Recommendation:-

 

The officers recommendation remains as an Approval.

Councillor Richards proposed that permission be granted. In the absence of a seconder, the motion was not put to the vote.

 

Notwithstanding the officer’s recommendation that permission be granted and following an indication at the previous meeting that members were minded to refuse permission, concern was expressed that the application was outside of the settlement boundary and had an impact on the character and landscape of the area contrary to policy DM4 and the design and materials of the cabins were not in keeping with surrounding properties and it was therefore contrary to policy DM10. It was moved by Councillor Cook and seconded by Councillor Hall that permission be refused for these reasons.

 

The time having reached 9.30pm, it was moved by Councillor Witherford, seconded by Councillor Crooks and

 

RESOLVED – the meeting be permitted to continue after 9.30pm.

 

On returning to the discussion and the motion of Councillor Cook, seconded by Councillor Hall that permission be refused, the motion was put to the vote and subsequently CARRIED and it was therefore

 

RESOLVED – planning permission be refused for the following reasons:

 

(i)            The timber cabins, by virtue of their location outside of a defined settlement, along with the creation of an access road, would introduce urbanising features within a countryside location which would be detrimental to the intrinsic value and open character of the surrounding countryside, contrary to Policy DM4 of the Site Allocations and Development Management Policies DPD (adopted July 2016);

 

(ii)           The timber cabins by virtue of their design, form and materials would not respect the materials or design of adjoining buildings. The cabins would therefore have an adverse effect on the visual amenity of the surrounding area, contrary to Policy DM10 of the Site Allocations and Development Management Policies DPD (adopted July 2016).

‘Late items:’

 

Introduction:-

 

It has been brought to the attention of the LPA that part of the proposed access is outside of the red line on the site plan. The applicant has submitted a revised site plan showing the majority of the access included within the red line and has confirmed that the land is within her ownership.

 

Consultations:-

 

LCC Highways are aware of this and have advised that the applicant conduct a Highway Boundary Search via their Highway Records department. The applicant has taken this advice but the results of this search have not yet been sent through.

 

Appraisal:-

 

The alterations to the red line do not change the Officer recommendation to Approve. Any works to the Highway on Highways land would need a separate agreement in place from the Highways Authority.

 

Recommendation:-

 

Condition 2 to be revised to read

 

The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans:

Notwithstanding the officer recommendation that permission be granted, some members felt that the development and its design was not complementary to or reflective of the neighbouring properties and would have a significant adverse effect upon the character of the countryside of the area. It was moved by Councillor Cook and seconded by Councillor Hollick that they be minded to refuse permission. Upon being put to the vote, the motion was CARRIED and it was

 

RESOLVED – members be minded to refuse the application and it be brought back to the next appropriate meeting.
