Consultations:-

 

For clarification the number of representation received in relation to the original submission reference in paragraph 5.2 should read 34 Letters of objection from 29 addresses.

 

Following the receipt of amended plans which reduce the height of the proposed building, reduced the number of dwellings across the site and retained the public car park; a further four representations have been received; the comments are summarised below:-

 

1)         Pleasing to see the reduced height of the apartment block;

2)         Thanks for the reduction in dwellings and improving the parking provision; including the retention of the public carpark;

3)         Concerns for rat-running and increase parking on Trinity Vicarage Road;

4)         Traffic calming measures should be introduced;

5)         Parking spaces should be marked and allocated, every space should have vehicle charging facilities;

6)         Retained element of the car park should be made available during construction;

7)         One way system should be considered, on street parking is an issue in the area;

8)         There are other developments happening in the area with lack of parking;

 

Appraisal;-

 

With reference to the above, traffic calming measures are now proposed along the access road, this includes a speed table at the entrance of the public car park, close to the junction with Trinity Vicarage Road, and each apartment is allocated 1 parking space.

 

Additional condition:-

 

31.       No development shall take place until a programme of archaeological work, comprising further post-determination trial trenching, specific metal-detecting and as necessary targeted archaeological investigation.  The full programme and timetable will be detailed within a Written Scheme of Investigation, submitted to and approved by the local planning authority in writing.  The scheme shall include an assessment of significance and research questions; and:

 

           The programme and methodology of site survey, investigation and recording (including assessment of results and preparation of an appropriate mitigation scheme)

           The programme for post-investigation assessment

           Provision to be made for analysis of the site investigation and recording

           Provision to be made for publication and dissemination of the analysis, interpretation and presentation of the site investigation

           Provision to be made for archive deposition of the analysis and records of the site investigation

           Nomination of a competent person or persons/organisation to undertake the works, with particular reference to the metal detecting survey, as set out within the Written Scheme of Investigation.

 

No development shall take place other than in accordance with the Written Scheme of Investigation approved through condition.

 

Reason: To allow proper investigation and recording of the site, which is potentially of archaeological and historic significance in accordance with Policies DM11, DM12 and DM13 of the adopted Site Allocations Development Management Policies Development Plan Document (2016).

Councillor Bray, seconded by Councillor RG Allen proposed that permission be granted with an additional condition to allocate car parking. Upon being put to the vote the motion was carried and it was

 

RESOLVED

 

(i)            Permission be granted subject to

 

a.    A condition being imposed requiring that a S106 agreement be entered into prior to the commencement of development to secure the following obligations:

·         Health - £17, 574.48

·         Education – to be provided

·         Civic Amenity - £3,616.00

·         Libraries - £1,980.00

·         Highways - £22,500 towards two Traffic Regulation Orders, two six month bus passes per dwelling, appointment of travel plan co-ordination, £6,000 travel plan monitoring fee, land to be gifted to LCC Highways for the provision of a cycle route.

·         Town Centre Improvements - £170,000.00

·         Public Open Space - £137,482.30

·         20% Affordable Housing on site with a 50:50 tenure split of affordable rent and affordable home ownership

 

b.    Planning conditions outlined in the report, in late items and the above mentioned additional condition.

 

(ii)           That the Planning Manager be granted powers to determine the final detail of planning conditions;

 

(iii)          That the Planning Manager be granted powers to determine the terms of the S106 agreement including trigger points claw back periods.

Introduction:-

 

Adjustments to the contributions for the Section 106 agreement have been made due to the removal of one dwelling from the scheme. Leicestershire County Council (Highways) have also requested an additional Traffic Regulation Order (TRO) along Marchant Road as mitigation.

 

An amended materials schedule has also been received to clarify where the materials will be on the dwellings.

 

Consultations:-

 

An additional neighbour letter has been received objecting to the scheme for the following reasons:

-           Loss of the car park

-           Impact upon highway safety (vehicular and pedestrian)

-           Increase in congestion along Coventry Road

 

A letter of objection has been received from Councillor Bray his comments were incorporated into the Committee Report within Section 5 – Publicity of the Committee Report.

Due to the reduction of on site dwellings from 107 to 106 the play and open space contributions have been adjusted and the overall contributions towards on site maintenance and off site provision and maintenance of open space is £220,870.05. Education

After re-consulting Leicestershire County Council (Education) on the loss of one dwelling they have reviewed the educational need in the area. Reviewing the places available it is concluded that there is a deficit of 30 pupil places within the primary school sector within a 2 mile walking distance which is more of a deficit than when the original contribution was calculated. Therefore a contribution towards the accommodation of capacity issues caused by the proposed development is requested. The amended primary school figure is £101,414.40.

 

An additional contribution is now being sought for secondary education or post-16 education as it is identified there is now a deficit of places for these educational facilities. There is an overall deficit in this sector after including all schools within a three mile walking distance of the development of 10 pupil places. Therefore a contribution towards the accommodation of capacity issues caused by the proposed development is requested. The contribution is calculated by multiplying the number of deficit places created by the development (3.99) by the DFE cost multiplier (£17,876.17) which equals £71,325.92.

The overall education contribution figure is £172,740.32.

 

The amended figures are considered necessary and directly related and fairly and reasonably related in scale and kind to the development proposed and therefore meets the CIL tests.

 

Libraries

Minutes:

Application for erection of 17 houses and 89 apartments within two apartment blocks including provision of access, open space and associated infrastructure.

 

Notwithstanding the officer’s recommendation that permission be granted subject to a section 106 agreement and conditions, some members felt that the proposed development was out of keeping with the area and the design, scale and density would harm the character of the area contrary to policy DM10 of the SADMP and paragraph 127 of the NPPF. It was moved by Councillor Bill and seconded by Councillor Nichols that the committee be minded to refuse permission. Upon being put to the vote, the motion was CARRIED and it was

 

RESOLVED – the committee be minded to refuse permission and the application be brought back to a future meeting for determination.

 

Councillors Bray and Hall left the meeting at 7.29pm.
