Application for hybrid planning application comprising outline permission (access, scale and landscaping) for the erection of up to 5000 sqm of B8 storage and full permission for extension to existing manufacturing unit (B2/B8) with associated access, landscaping and drainage works.

 

‘Late items:’

 

Introduction:-

           

An amended plan has been submitted which indicates the position of the existing access on the Proposed Site Layout and Sections plan, for clarification.

 

Consultations:-

 

An additional consultation response has been received from Markfield Parish Council raising the following comments which have not been raised previously:-

 

1)         The extension is into open countryside

2)         Proper safeguarding has not been demonstrated for adjoining neighbours regarding the escalation in activity

3)         Failure to recognise the detrimental noise impact and increased vehicular activities

4)         Presently working hours are limited, the proposal suggests operations would be 24/7, causing loss of amenity

5)         Moving bunding and mature hedges at the present entrance is unacceptable and will expose residents while new screening is installed

 

An additional consultation response has been received from Cllr. M. Lay raising the following comments which have not been raised previously:-

 

1)         Presently works are not taking place 24/7 7 days a week and never have. This application will introduce new manufacturing on site and a potential to ramp up activity in a single site all hours all days without limit

2)         Just the vehicle movements alone will cause a loss of amenity but the additional and new manufacturing activity on Sundays, Bank Holidays and night time’s will be a huge detriment to local people

3)         The moving of the bunding and the fully grown hedges at the present entrance is unacceptable and will expose residents to the operations while new screening is installed and hedges grow again. This is unacceptable and fully avoidable

4)         I also remain concerned that the entrance further up on the new development is still unsatisfactory but recognise this is a highways matter

 

Appraisal:-

The amended plan is for clarification and does not alter the assessment of the access already made; or change the recommendations of the report.

 

The concerns raised in the additional comments have been addressed in the report to Committee. LCC (Highways) do not object to the application as set out in the Committee report.

 

Recommendation:-

 

The recommendations to committee have not changed from the original report subject to amended conditions below;

3.         Development implemented within each phase shall not be occupied until such time as the parking, turning and layout arrangements shown on Proposed Site Plan / Sections Dwg. No. 7627-03-004 Rev F received on 13th December 2018 for that phase have been implemented in full. Thereafter the onsite parking and turning provision serving each phase shall be so maintained in perpetuity.

12.       Prior to occupation of the building given consent in phase 1, details of the noise barrier shown on Dwg. No. 7627-03-004 Rev F received on 13th December 2018 shall be submitted to and approved in writing by the Local Planning Authority. The details shall include:-

 

           Barrier specification and location

           Conformation of the mitigation provided by the structure and the resultant noise levels at the nearest residential premises.

The noise barrier shall then be installed prior to first use of the development, and maintained thereafter unless agreed otherwise by the local planning authority.

Minutes:

It was moved by Councillor Bessant, seconded by Councillor Crooks and

 

RESOLVED

 

(i)            Permission be granted subject to:

 

a.    The prior completion of a S106 agreement to secure the following obligations:

 

·         £64,582.80 towards improvements along the A511, specifically the A511/B591 junction (flying horse) and the A511/B585 junction

·         £3,500 per stop to the two nearest stops for bus stop improvements (to allow level access)

·         £5,500 per stop to the two nearest stops for Real Time Information systems

·         £6,000 monitoring fee for Leicestershire County Council to support the Travel Plan Co-ordinator

 

b.    The conditions contained in the officer’s report and late items;

 

(ii)           The Interim Head of Planning be granted delegated powers to determine the final details of the planning conditions;

 

(iii)          The Interim Head of Planning be granted delegated powers to determine the terms of the S106 agreement including trigger points and claw back periods.
