Declarations of interest To receive verbally from Members any disclosures which they are required to make in accordance with the Council’s Code of Conduct or in pursuance of Section 106 of the Local Government Finance Act 1992. This is in addition to the need for such disclosure to be also given when the relevant matter is reached on the agenda. Minutes: No interests were declared at this stage. |

Licensing Charitable Collections Policy To inform members of the draft Charitable Collections Policy and seek support for consultation. Additional documents:
Minutes: The Committee was informed of the draft Charitable Collections Policy which was recommended for consultation.
A member asked whether there was the ability to inspect records following a collection where concern had been raised. In response it was noted that the Police could do so and that officers would report it if they had concerns. In addition, the Charities Commission kept records of returns. It was moved by Councillor Cartwright and seconded by Councillor Hodgkins that the right to inspect records be included in the policy. This received the support of the Committee.
Concern was expressed in relation to charity bags and how the public were to know if the bag was from a legitimate charity with permission to collect. In response, members were informed that there was usually a number to contact on the bag to check and also that people could call the council who would check its records.
It was moved by Councillor Cartwright, seconded by Councillor Hodgkins and
RESOLVED – the draft policy be approved for consultation with the addition of provision for officers to inspect records. |

Street Trading Consent policy revision To present a revised policy, seek support for requiring traders in Hinckley Town Centre to obtain a Street Trading Consent and support for consultation thereon. Additional documents: Minutes: Members received a report which recommended a revision to the Street Trading Consent policy following the change in street configuration in Hinckley due to the opening of the Crescent which was in private ownership and therefore could not be covered by the policy.
Discussion ensued in relation to the requirement that street traders be DBS checked. Some members felt that this was very important whilst others felt that it was an onerous requirement given that the services provided by the telecommunication companies which were most affected by this were for over 18s anyway. Members asked officers to check with neighbouring authorities as to whether they included this requirement in their policies in relation to telecommunication companies and other companies whose goods were aimed at over 18s, and to consult with members outside of the meeting to come to a decision on whether to continue to require DBS checks for telecommunication companies and those whose goods were aimed at over 18s.
A member asked a question in relation to Peddlers Licences and whether that permitted them to peddle anywhere. Officers agreed to look into it and respond outside of the meeting.
It was moved by Councillor Nichols, seconded by Councillor Nickerson and
RESOLVED –
(i) Officers, following consultation with members, be granted delegated authority to amend the policy for consultation following research on the policies of neighbouring authorities;
(ii) Subject to the above, the revised policy be endorsed for consultation. |
