Town & Country Planning Act 1990 - applications to be determined

Schedule of planning applications attached.

Minutes:

A schedule of planning applications was presented to members and considered as follows:

 

(a)        13/00579/HOU – Extensions and alterations to dwelling, 49 Stamford Drive, Groby – Mr S Dempsey

 

            It was noted that this item had been withdrawn from the agenda.

 

(b)        13/00658/COU – Change of use of land to holiday park and siting of 4 static caravans (part retrospective), The Oaks, Stapleton Lane, Kirkby Mallory – Mr G Penney

 

            It was noted that this item had been withdrawn from the agenda.

 

(c)        13/00413/FUL – Subdivision of 112 Main Street into separate units and creating a new access through existing garage onto Main Street, Higham on the Hill – David Wilkinson

 

A Member felt that the highways issues had not been adequately addressed and that the heritage of the site had not been given due consideration and it was moved by Councillor Ward and seconded by Councillor Boothby that the application be deferred for further consideration of these issues. Upon being put to the vote, the MOTION was LOST.

 

It was moved by Councillor Bannister and seconded by Councillor Cartwright that the application be approved.

 

Councillor Witherford then moved an AMENDMENT that the application be approved with the omission of the railings shown on the plans. This amendment was seconded by Councillor Bannister who, along with Councillor Cartwright, agreed to accept the amendment. It was therefore

 

RESOLVED – the application be approved with the abovementioned amendment subject to the conditions contained in the officer’s report and late items.

 

(d)        13/00424/FUL – Erection of dwelling, land rear of 86 Leicester Road, Hinckley – Mrs Jane Carrara Chambers

 

On the motion of Councillor Sutton, seconded by Councillor Allen, it was

 

RESOLVED – subject to an Agreement under Section 106 of the Town and County Planning Act 1990 and Section 111 of the Local Government Act 1972 or receipt of an acceptable Unilateral Undertaking under S106 of the Town and Country Planning Act 1990 to provide financial contributions towards play and open space, the Development Control Manager be granted delegated powers to grant planning permission subject to the conditions contained in the officer’s report. Failure to complete the said agreement by 23 September 2013 might result in the application being refused.

 

(e)        13/00458/FUL – Demolition of existing public house and erection of three detached dwellings, Bulls Head, Main Street, Nailstone – Mr Andrew Lloyd

 

On the motion of Councillor Inman, seconded by Councillor Crooks, it was

 

RESOLVED – the application be refused for the reasons contained in the officer’s report.

 

(f)         13/00600/FUL – Installation of a wind turbine (30m hub height, 42m blade tip height), Land north of Merrylees Road, Thornton – Urban Wind Ltd

 

On the motion of Councillor Sutton, seconded by Councillor Crooks, it was

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report.

 

(g)        13/00056/FUL – Erection of 29 residential units, 71 Park Road, Ratby – Mr Michael Gisborne

 

On the motion of Councillor Hulbert, seconded by Councillor Lynch, it was

 

RESOLVED – subject to an agreement under Section 106 of the Town and Country Planning Act 1990 and Section 111 of the Local Government Act 1972 or receipt of an acceptable Unilateral Undertaking under S106 of the Town and Country Planning Act 1990 to provide affordable housing, the Development Control Manager be granted delegated powers to grant planning permission subject to the conditions contained in the officer’s report.

 

(h)        13/00416/FUL – Replacement agricultural building (part retrospective), Tooley Park Farm, Peckleton Common, Peckleton – Mr Peter Draycott

 

On the motion of Councillor Boothby, seconded by Councillor Allen, it was

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report and late items.

 

(i)         13/00534/FUL – Erection of 2 industrial buildings, Maple Drive, Hinckley – Mr Jeff Penman

 

On the motion of Councillor Crooks, seconded by Councillor Sutton, it was

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report and late items.

 

(j)         13/00566/EXT – Extension of time for extant planning permission 10/00514/OUT for residential development (access), Manor Farm, Main Street, Thornton – Mr John Brown

 

On the motion of Councillor Boothby, seconded by Councillor Crooks, it was

 

RESOLVED – subject to the execution of an agreement under Section 106 of the Town and Country Planning Act 1990 and Section III of the Local Government Act 1972 towards the provision of affordable housing and provision and maintenance of off-site public play and open space facilities, the Development Control Manager be granted powers to issue outline planning consent, subject to the conditions contained in the officer’s report.

 

(k)        13/00610/FUL – Change of use of land and installation of a tennis court, Coton Priory, Priory Lane, Far Coton – Mr Chris Stamper

 

It was moved by Councillor Chastney, seconded by Councillor Crooks and

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report.
