Town & Country Planning Act 1990 - applications to be determined

Schedule of planning applications attached.

Minutes:

A schedule of planning applications together with late items was presented to the committee and decisions were made as follows:

 

(a)        14/00090/HOU – Extensions and alterations to dwelling (retrospective), 1 Temple Hall Farm Cottages, Bosworth Road, Wellsborough – Mrs Clare Goodwin

 

            In presenting the item, the Chief Planning & Development Officer clarified that if members were minded to refuse the application, enforcement action would then be required. Members had viewed the site and also referred to pictures and plans presented at the meeting and listened to the representations of an objector and the applicant. It was moved by Councillor Morrell, seconded by Councillor Bannister and

 

RESOLVED

 

(i)         the application be refused for the reasons contained in the officer’s report;

 

(ii)        the serving of an enforcement notice to secure removal of the unauthorised rear extension be authorised.

 

(b)        14/00380/CONDIT – Variation of condition 2 of planning permission 13/00933/HOU to amend approved plans, 68 The Ridgeway, Burbage – Mr and Mrs David Denyer

 

            Notwithstanding the officer recommendation that the application be approved, some members felt that the proposal would adversely affect the amenity of occupiers of the adjacent property due to its height and proximity, contrary to policy BE1. It was MOVED by Councillor Inman and seconded by Councillor Moore that the application be refused on these grounds. The Chief Planning & Development Officer requested that voting on this motion be recorded. The vote was taken as follows:

 

            Councillors Gould, Inman, Moore, Sutton, Taylor and Ward voted FOR the motion (6);

 

            Councillors Allen, Batty, Hodgkins, Hulbert, Lynch, Morrell, Smith and Witherford voted AGAINST the motion (8);

 

            Councillors Bannister and Mayne abstained from voting.

 

            The MOTION was therefore declared LOST. It was then moved, seconded and

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report.

 

(c)        14/00503/FUL – Erection of 43 dwellings with associated access (revised proposal), Land off Hilary Bevins Close, Higham on the Hill – Helen Bareford

 

            Notwithstanding the officer’s recommendation that the application be approved subject to conditions and a S106 agreement, some members felt that the application was unacceptable due to concerns about highway safety and because the proposed development would adversely affect the vitality of the rural community. It was MOVED by Councillor Ward and seconded by Councillor Morrell that the application be REFUSED for these reasons. The Chief Planning and Development Officer requested that voting on the motion be recorded. The vote was taken as follows:

 

            Councillors Allen, Morrell, Smith, Sutton and Ward voted FOR the motion (5);

 

            Councillors Bannister, Gould, Hodgkins, Hulbert, Inman, Lynch, Moore, Taylor and Witherford voted AGAINST the motion (9);

 

            Councillors Batty and Mayne abstained from voting.

 

            The motion was therefore declared LOST.

 

            It was moved by Councillor Hulbert, seconded by Councillor Gould and

 

RESOLVED – planning permission be granted subject to the conditions and section 106 agreement outlined in the officer’s report.

 

(d)        14/00174/OUT – Erection of a single dwelling (outline – all matters reserved), land rear of 178 Hinckley Road, Earl Shilton – Pegg Gilbert & Lally

 

It was moved by Councillor Allen, seconded by Councillor Bannister and

 

RESOLVED – the application be refused for the reasons set out in the officer’s report.

 

(e)        14/00257/FUL – Extension to agricultural building and hardcore apron, Groby Park Farm, Bradgate Hill, Groby – Fletcher and Sons

 

Whilst generally in support of the officer’s recommendation that the application be permitted, a member raised the concern that the parish council had said they had not been consulted. It was requested that the decision be delegated to officers following consultation with the parish council. It was moved by Councillor Batty, seconded by Councillor Sutton and

 

RESOLVED – Members be minded to permit the application, with the decision delegated to officers following consultation with the parish council.

 

(f)         14/00275/FUL – Proposed livestock building, manure and slurry storage areas and rainwater harvesting system, New Hall Farm, Main Road, Sheepy Magna – Mr & Mrs Stephen & Anne Parkinson

 

On the motion of Councillor Morrell, seconded by Councillor Allen, it was

 

RESOLVED – the application be permitted subject to the conditions contained in the officer’s report.
