It was noted that minute 40 recorded apologies from Mr Cope but should have read ‘Mrs Cope’. It was moved by Councillor Rooney, seconded by Councillor Allen and

 

RESOLVED – the minutes of the meeting held on 30 June 2015 be confirmed subject to the abovementioned amendment and signed by the Chairman.

To receive verbally from Members any disclosures which they are required to make in accordance with the Council’s Code of Conduct or in pursuance of Section 106 of the Local Government Finance Act 1992. This is in addition to the need for such disclosure to be also given when the relevant matter is reached on the agenda.

Decisions delegated at previous meeting

The Deputy Chief Executive (Community Direction) to report progress on any decisions delegated at the previous meeting.

It was reported that all decisions delegated at the previous meeting had been issued with the exception of 14/00426/OUT which was awaiting completion of the Section 106 agreement.

Notwithstanding the officer’s recommendation that the application be approved, some members felt that it was unacceptable on grounds of highway safety due to inadequate visibility and unsafe vehicular access. It was MOVED by Councillor Wright and seconded by Councillor Taylor that the application be refused. Upon being put to the vote the motion was declared CARRIED and it was therefore

 

RESOLVED – the application be refused on grounds of highway safety due to inadequate visibility and failure to demonstrate that an appropriate and safe vehicular access would be provided.

 

Councillor Rooney left the meeting at 6.55pm.

Application for proposed livestock building with associated access and landscaping.

 

It was moved by Councillor Taylor that the officer’s recommendation to approve the application be supported. Some members, however, felt that the proposal would result in intrusion into the countryside and that there was no proof of need. It was moved by Councillor Boothby and seconded by Councillor Allen that the application be refused for these reasons. Councillor Witherford then seconded Councillor Taylor’s proposal, however as the first valid motion, Councillor Boothby’s was put to the vote and CARRIED. It was therefore

 

RESOLVED – the application be refused on the basis of unwarranted intrusion into the countryside (policy BE1 criterion a and policy NE5 of the Hinckley & Bosworth Local Plan 2001) and no proof of need for the development.

It was moved by Councillor Boothby that the application be refused. Following subsequent discussion and in the absence of a seconder, this motion was withdrawn.

 

Due to concerns raised during the meeting, members felt unable to make a decision on the application due to the risk of detrimental impact on neighbouring properties. It was moved by Councillor Witherford and seconded by Councillor Taylor that consideration of the application be deferred to allow for discussion with the applicant. Upon being put to the vote the motion as CARRIED and it was

 

RESOLVED – the application be deferred for further discussion with the applicant.

Councillor Taylor moved that the application be approved but in the absence of a seconder, this motion fell.

 

Members felt they required more detail on the number of vehicles on site at any one time and it was moved by Councillor Boothby and seconded by Councillor Cook that the application be deferred for this purpose. Upon being put to the vote, the motion was CARRIED and it was

 

RESOLVED – the application be deferred to receive more information on vehicle movements.

It was moved by Councillor Sutton and seconded by Councillor Boothby that the application be approved. Upon being put to the vote there were seven (7) votes FOR the motion and seven (7) votes AGAINST. The Chairman exercised his casting vote under paragraph 18.2 of the Council’s Constitution, voting FOR the motion. The motion was therefore declared CARRIED and it was
