Declarations of interest

To receive verbally from Members any disclosures which they are required to make in accordance with the Council’s Code of Conduct or in pursuance of Section 106 of the Local Government Finance Act 1992. This is in addition to the need for such disclosure to be also given when the relevant matter is reached on the agenda.

Minutes:

Councillors Cope, J Crooks, W Crooks, Flemming and Hollick declared a personal interest in application 20/00400/FUL as members of English Heritage.

 

Although in attendance as ward councillor and not a member of the committee, Councillor Morrell wished it to be noted that he had a personal interest in application 20/00400/FUL as a customer of the retail facility.

Decisions delegated at previous meeting

To report progress on any decisions delegated at the previous meeting.

Minutes:

It was reported that the decision relating to application 20/00984/OUT had been issued. The decisions in relation to applications 19/00464/OUT and 20/00919/OUT had been deferred at the previous meeting. The decision in relation to application 20/00779/OUT was subject to a section 106 agreement.

Application for erection of a new workshop and ancillary services building, new wash bay building and change of use of land to create an agricultural machinery display area.

 

Late items received after preparation of main agenda:

 

Introduction:-

 

Following the publication of the committee report, the applicant has submitted an amended site layout and location plan.

 

Consultations:-

 

A re-consultation has taken place with the Highway Authority with regards to the amended site layout which alters the car parking spaces proposed. The internal layout of the site has been revised to 32 parking spaces for employees/visitors and one disabled/accessible parking space. Whilst this is a decrease of 4 parking spaces compared to the original proposal, the Highway Authority confirm that they have no objection to this small reduction in parking spaces as this reduction will remove the potential conflict between vehicles entering/exiting the site and parked cars and will also allow more manoeuvrability within the site for larger vehicles that visit the site.

 

The Highway Authority welcome the inclusion of cycle parking and request that planning conditions are imposed if consent is granted.

 

Recommendation:-

 

The recommendation contained in the Committee Report remains unaltered.

It was moved by Councillor Findlay and seconded by Councillor Furlong that permission be refused for the reasons contained in the officer’s report.

 

It was subsequently moved by Councillor Boothby and seconded by Councillor Cook that permission be granted.

 

As the first valid motion, the proposal to refuse permission was put to the vote and CARRIED. It was therefore

 

RESOLVED – permission be refused for the reasons contained in the officer’s report.

Application for erection of five dwellings.

Minutes:

Application for erection of five dwellings.

 

It was moved by Councillor Findlay and seconded by Councillor Boothby that permission be granted subject to the conditions contained in the officer’s report.

 

It was subsequently moved by Councillor Sheppard-Bools and seconded by Councillor Walker that permission be refused due to being contrary to policy DM9 in relation to the footpath.

 

Being the first valid motion, the proposal to approve was put to the vote and LOST.

 

Following officer advice, Councillor Sheppard-Bools, with the agreement of Councillor Walker, withdrew the motion to refuse.

 

It was moved by Councillor Sheppard-Bools and seconded by Councillor Walker that the application be deferred for further consideration. Upon being put to the vote, the motion was CARRIED and it was

 

RESOLVED – the application be deferred.

To provide an update on a number of major schemes in the borough.

Minutes:

Members received an update on major schemes in the borough. It was agreed that future reports would contain information on those schemes that had been granted permission but building had not commenced and applications that were in the pipeline.

 

A member queried whether Nailstone Country Park was in fact open to the public as stated in the report. In response it was reported that this update had been provided by the applicant and related to the part of the country park accessed from Battram rather than from the south.

 

Another member referred to former highway land at Leicester Road, Groby which the report referred to being under construction and said that the properties were completed and occupied. He asked for more information on the content of the S106 agreement and receipt of monies. It was agreed that this information would be provided outside of the meeting.
